Bursor & Fisher Defeats Summary Judgment Motion In Bell + Howell Lawsuit
On September 5, 2018, Judge William H. Pauley III of the United States District Court for the Southern District of New York denied the defendant’s motion for summary judgment in Joanne Hart v. BHH, LLC, clearing the way for a jury trial early next year on claims that the defendants’ ultrasonic pest repellers are ineffective and worthless. Judge Pauley had previously granted the plaintiffs’ motion to certify a nationwide class and to appoint Bursor & Fisher, P.A. as Class Counsel. More than $50 million in sales were made to the nationwide class.
