Class Certification Granted in Landmark VPPA Lawsuit Against WebMD

On February 20, 2025, the Honorable Thomas W. Thrash Jr. of the Northern District of Georgia issued an Opinion and Order granting Plaintiff’s motion for class certification in the case captioned Jancik v. WebMD LLC, Case No. 1:22-cv-00644 (N.D. Ga.).  Plaintiff alleges WebMD violated the Video Privacy Protection Act (“VPPA”) by unlawfully sharing its website users’ video viewing activity with unknown third parties such as Facebook.  Judge Thrash’s order is a tremendous victory as it marks the first ever granting of a contested certification under the VPPA.  Plaintiff is represented by Philip Fraietta and Alec Leslie of Bursor & Fisher’s New York City office.
