Court Certifies Class In University of Delaware Case
On March 31, 2023, Circuit Judge Stephanos Bibas, sitting by designation in the United States District Court for the District of Delaware, granted a motion to certify a class defined as “All undergraduate students enrolled in classes at the University of Delaware during the Spring 2020 semester who paid tuition.” The Court also appointed Bursor & Fisher, P.A. as class counsel. The class is seeking to recover damages stemming from the University of Delaware’s refusal to provide refunds despite the fact that half of the Spring 2020 semester was online instead of in-person as planned.
“The Court’s order certifying a class is a significant development in this case, allowing students to join together to prosecute this action,” said Josh Arisohn, one of the firm’s attorneys staffed to the matter. “We look forward to moving this case toward trial.”
