Court Certifies Class In Valsartan Recall Case
On February 8, 2023, Judge Robert B. Kugler of the United States District Court for the District of New Jersey granted a motion to certify an “economic loss” class of purchasers of Valsartan-containing prescription medications that were recalled by the U.S. Food and Drug Administration due to contamination with n-nitrosodimethylamine, a carcinogen also known as “NDMA.” The economic loss class seeks to recover money paid by consumers for the recalled medication.
“Judge Kugler’s order certifying the class is a significant development in this case, allowing purchasers of Valsartan to join together to prosecute this action,” said Neal Deckant, one of the firm’s attorneys staffed to the matter. “We look forward to moving this case toward trial.”
