Kombucha Class Action Settlement Approved
On August 23, 2017, Judge Philip S. Gutierrez of the United States District Court for the Central District of California granted final approval to the $8.25 million class action settlement in Retta v. Millennium Products, Inc. Bursor & Fisher, P.A. filed the lawsuit in 2015 alleging that Millennium misrepresented the alcohol, sugar and antioxidant content of its kombucha tea products.
The settlement followed more than two years of litigation and provides up to $35 in cash or product vouchers to class members without proof of purchase. Class members with proof of purchase can receive up to $60 in cash or product vouchers. In approving the settlement, the Court noted that the case was “hard-fought” and that Bursor & Fisher “achieved results that represent a significant recovery for the Class.”

We are thrilled that nearly 200,000 class members will receive a cash recovery that will compensate them for more than the full amount of their alleged damages.”
